SmartVan is an AI-powered assistance system. The information provided is for guidance only and may contain errors. It should not be considered definitive technical or legal advice. Users assume full responsibility for decisions made based on SmartVan's responses.

✍️ Terms of Use – SmartVan

1. Purpose

SmartVan is an AI-based assistance system providing indicative information about RVs and campervans, drawing from public manuals and online sources. Our chatbot operates on a third-party platform.

2. Nature of AI

Users acknowledge they are interacting with an artificial intelligence system classified as limited risk under the European Artificial Intelligence Regulation (AI Act). Responses are automatically generated and may contain errors or inaccuracies.

3. Responsible Use

Users agree to use the system appropriately, acknowledging that:

  • There is no direct human supervision.
  • The information does not replace professional technical advice.
  • Critical decisions (e.g., safety or maintenance) should not be made solely based on SmartVan's information.

4. Limitation of Liability

SmartVan is an automated AI assistance system. The information provided is indicative and may contain errors. It should not be considered definitive technical or legal advice. Users assume full responsibility for decisions made based on SmartVan's responses. The developing company is not responsible for damages arising from the use, interpretation, or application of AI-generated information.

5. RV and Campervan Technical Information Registration

Users may voluntarily provide information about their RV or campervan and its installed components. This information is used exclusively to personalize SmartVan's assistant responses and offer recommendations tailored to the vehicle's configuration.

Users are responsible for the veracity and accuracy of the data provided. The processing of such information is carried out under the legal basis of legitimate interest and/or user consent, in accordance with Article 6 of the GDPR.

6. Data Protection

SmartVan does not intentionally collect sensitive personal data or use user data to train the system. However, using the assistant or associated forms may involve the automatic processing of user-entered information, such as email addresses or vehicle technical data.

  • It will not be shared with third parties without express consent.
  • It will be sent to the corresponding Artificial Intelligence models anonymously.
  • It can be deleted at the user's request by writing to: info@smartvan.es.

The technical infrastructure supporting SmartVan may be located outside the European Economic Area (EEA). However, user data is not used for AI model training or for purposes other than those strictly necessary for service operation.

7. Compatibility and Technical Limitations of External Platforms

The SmartVan assistant operates through external platforms like ChatGPT and other messaging or web access tools, which have their own technical limitations and terms of use. Therefore:

  • The availability and functionality of the assistant may be affected by service outages, updates, or changes in these platforms' policies.
  • Some functionalities (e.g., sending images, links, or documents) may not be available on certain platforms or versions.
  • The quality and speed of response may depend on the user's access plan (e.g., using ChatGPT with or without a ChatGPT Plus subscription).
  • Compatibility with all devices, browsers, or messaging applications is not guaranteed. Users are responsible for using an updated and functional version of the chosen channel.

8. Artificial Intelligence Models

SmartVan uses third-party artificial intelligence models to generate responses. These models may have inherent limitations or temporary outages. Users acknowledge that:

  • The company does not control the operation or availability of these models.
  • Generated responses may not be accurate or up-to-date.
  • Users must verify critical information with official sources or qualified professionals.

9. Third-Party Chatbot Platforms

The SmartVan chatbot is built and operated using a third-party software platform. By interacting with our chatbot, you acknowledge that an external entity provides the underlying platform.

  • User Content: Any data, configurations, or workflows you submit or generate through the chatbot are your property. However, you grant the third-party platform a non-exclusive, worldwide, royalty-free license to use, host, and process such content solely to operate and improve the platform's services.
  • Third-Party Platform Limitation of Liability: To the maximum extent permitted by law, the third-party platform provider will not be liable for indirect, incidental, or consequential damages, or losses resulting from the use, delay, or inability to use its platform, or from content submitted or actions taken by SmartVan's end-users.
  • Applicable Law for Third-Party Platform: The terms of service of the third-party platform may be governed and interpreted under laws different from SmartVan's.

10. Applicable Law

These conditions are governed by current Spanish and European legislation, especially the General Data Protection Regulation (GDPR), the LOPDGDD, and the European Artificial Intelligence Regulation (AI Act).

By confirming your subscription, you authorize the immediate start of the service and the personalization of your SmartVan assistant based on your vehicle data.

For this reason, you waive the 14-day right of withdrawal, in accordance with Article 103.m of Royal Legislative Decree 1/2007.

🔒 Pre-sale Conditions

Purchasing SmartVan in pre-sale offers the opportunity to keep the reduced price for life, and the assistant will be activated within a few weeks after purchase, as soon as the official version is available, in order of reservation.

The service will have a duration of 12 months from the moment of its activation.

As this is a personalized digital service, once access is activated, the 14-day right of withdrawal will not apply, in accordance with Article 103.m of Royal Legislative Decree 1/2007.

In the event that the official version is not launched due to technical or operational reasons, the amount paid will be fully refunded to the user through the same payment method.

The price contracted during the pre-sale will be maintained in future renewals, provided that the user keeps their subscription active.
